Trading Card Sponsorship Agreement
Agreement between TintFam.com and the Trading Card Sponsor
This agreement is between TintFam.com ("TintFam") and the sponsor ("Sponsor") for the purpose of sponsoring trading cards.
The Sponsor agrees to provide TintFam with the Sponsor's logo in the formats required to fit on the trading card.
Quantity
The Sponsor may choose how many trading cards they wish to sponsor on the sponsorship page on the TintFam.com website. The Sponsor is not guaranteed a specific number of cards to sponsor. Availability depends on the number of unsigned cards in the current series.
Specific Cards
If the Sponsor wants to sponsor specific cards, they must provide the names of the cards and users in writing by emailing the information to tradingcardsponsorship@tintfam.com. TintFam will make a reasonable effort to accommodate the Sponsor's request, but cannot guarantee that specific cards will be available for sponsorship.
Payment
All sponsorship payments are non-refundable. Each trading card sponsorship is priced at $75, which covers printing, packaging, and distribution costs.
Logo Usage & Placement
The Sponsor's logo will appear in the "sponsored by" area on the rear of the trading card, below the featured person's stats and bio. TintFam reserves the right to resize or adjust the logo to fit the designated area while maintaining reasonable brand integrity. If the logo provided is not suitable for the available space, TintFam will contact the Sponsor to request an alternative format.
Distribution
Sponsored trading cards will be printed in a run of 250 per card design. Cards are packaged at random into foil packs of 10 and included with each issue of Tint Fam Magazine. Additional cards may be distributed via giveaways on live streams and other community events.
Representations and Warranties
The Sponsor represents and warrants that the logo provided by the Sponsor does not infringe any rights of third parties, and that the Sponsor has all necessary rights and authority to grant TintFam permission to use the logo on printed materials.
Indemnification
The Sponsor agrees to indemnify and hold TintFam and its affiliates, officers, agents, employees, partners, and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of Sponsor's breach of this Agreement, or Sponsor's violation of any law or the rights of a third-party.
Governing Law and Jurisdiction
This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) will be governed by and construed in accordance with the law of the United States. The courts of the United States will have non-exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
Acceptance of Agreement
By sponsoring trading cards through TintFam, the Sponsor agrees to be bound by the terms of this agreement.
Modification of Agreement
TintFam reserves the right to modify the terms of this agreement at any time and without notice.
