Trading Card Agreement
Agreement between TintFam.com and the User for Trading Card Creation
This agreement is between TintFam.com ("TintFam") and the user ("User") for the purpose of creating a physical trading card featuring the User's information.
The User agrees to provide TintFam with the information required to create the trading card, including but not limited to name, picture, and any other pertinent information deemed necessary by TintFam.
User's pictures: Before being sent to print, the user can email different pictures for use on their trading card to tradingcards@tintfam.com
Sponsorship: The User will have the option to sponsor their trading card themselves by providing their logo to be included on the card, or to allow someone else to sponsor the card. If the User chooses for someone else to sponsor the card, they have no say in who will be that sponsor.
Payment: All sponsorship payments are non-refundable.
Distribution: TintFam will distribute the trading cards in foil packs that include 10 random cards. The cards will be sent out with each issue of Tint Fam Magazine as well as used in giveaways.
Representations and Warranties: The User represents and warrants that (i) all information provided by the User to TintFam is true, accurate, current, and complete, and (ii) the User has all necessary right, power, and authority to enter into this Agreement and to perform the acts required of the User hereunder, and that the logo provided by the User or their sponsor does not infringe any rights of third parties.
Indemnification:The User agrees to indemnify and hold TintFam and its affiliates, officers, agents, employees, partners, and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of User's breach of this Agreement, or User's violation of any law or the rights of a third-party.
Governing Law and Jurisdiction: This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) will be governed by and construed in accordance with the law of the United States. The courts of the United States will have non-exclusive jurisdiction to settle any dispute or claim that arises out.
Acceptance of Agreement: By submitting their information to TintFam, the User agrees to be bound by the terms of this agreement.
Modification of Agreement: TintFam reserves the right to modify the terms of this agreement at any time and without notice.
